food products category - goods presented on the website http://sklepuquina.pl in the category of food products sold by QUY PHAM THI KIM QUIN ASIA, which can be ordered using the functionality of the website http://sklepuquina.pl in accordance with the Regulations, as also, at the Customer's request, collected from the U Quina Store or warehouse by suppliers or couriers and delivered to the place indicated by the Customer

Consumer - a natural person who purchases goods from the Seller for purposes not directly related to its business or professional activity

2. Shopping at http://sklepuquina.pl
2.1. Activity
The Asian store at Quina sells goods via the Internet. Orders can be placed via the website http://sklepuquina.pl or in our stationary store.
2.2. Working area
Services offered by http://sklepuquina.pl are available on the territory of the Republic of Poland. The possibility of order fulfillment is determined on the basis of the declared place of delivery.
2.3. Buyer
The http://sklepuquina.pl offer can only be used by adult natural persons with full legal capacity, defined according to the provisions of civil law, legal persons and other organizational units with legal capacity.
In order to use the offer presented on the website http://sklepuquina.pl, it is necessary to register the Customer's account on the website http://sklepuquina.pl in accordance with the Regulations. The customer may delete the account at any time by sending such information to the e-mail address: [email protected], tel: +48 602 736 737). If the account is deleted, all data will be deleted, except for the data necessary for the complaint process
and handling possible claims that will be stored until the expiry of the limitation periods for claims resulting from completed orders. The Customer's Account will be automatically deleted after a period of 3 years from the date of the last activity on the Account.
2.4. Product information
2.4.1 The information on the products offered for sale on the website http://sklepuquina.pl, such as: description, composition, calorific value, package weight, expiry dates, etc., come from the producers of the products. Quin's Store strives to keep them correct and up-to-date. Before using the products, the customer is required to read the information provided by the manufacturer on the product packaging.
2.4.2 The Store at Quina informs on the website about the expiry dates of the products currently available at http://sklepuquina.pl. The expiry dates of the products actually delivered may differ from those displayed on the website due to the rotation of products in the warehouse.
2.5. Products from the food products category
2.5.1 The contract for the sale of products listed on the Website in the category of food products is concluded with the company QUY PHAM THI KIM QUIN Asia, ul. Powstańców Wielkopolskich 18 lok. 2.15 / 02, 30-553 Kraków.
2.5.2. The place of concluding contracts for the sale of products is the point of sale located in Krakow at ul. Powstańców Wielkopolskich 18 lok. 2.15 / 02.
2.5.3. The customer whose order includes products from the food category undertakes to collect these products at a point of sale located in Krakow, address: ul. Powstańców Wielkopolskich 18 lok. 2.15/02 (in the U Quina Store), unless he has used the option of collecting, on his behalf, from the U Quina Store, the products purchased by the Customer and delivering them to the place of delivery indicated by the Customer in the order. .
2.6. Commodity prices
The prices of goods and delivery costs visible on the website http://sklepuquina.pl are gross prices [including VAT], expressed in Polish zlotys.

2.7. Order
The order is understood as the acceptance by the Customer of the offer http://sklepuquina.pl using the mechanisms of the store http://sklepuquina.pl, preceded by the acceptance of the choice of goods and the choice of payment method and delivery time, in accordance with point 3.1.
2.9. Sales contract and valid price
The sales contract between the Customer and the Seller is concluded at the premises of the Store at Quina and sends the Customer the order number to the Customer's e-mail address.
2.10. Delivery, delivery costs, packaging costs
2.10.1 The cost of delivery is specified each time in the ordering process. Similarly, the cost of packaging is specified each time in the ordering process.
Depending on the declared place or method, the delivery may be made through the suppliers of the Store at Quina or through a courier company acting on behalf of http://sklepuquina.pl

3. Customer's order
3.1. Submission and acceptance of the order
The order is made by selecting the products offered for sale from the offer on the website http://sklepuquina.pl. Adding products to the virtual basket is done after clicking the "Add to basket" button.
3.2. Acceptance of the order
Acceptance of the Customer's order will be confirmed electronically, i.e. by e-mail sent to the address provided by the Customer during Account registration. The order confirmation will include, among others: order number, delivery date and address, order value.
The commencement of the contract may in justified cases (e.g. in the case of a significant value of the order or when the order covers a large number of a given product, significantly different from the number that are usually the subject of orders, in the case of suspicion of providing false data by the person placing the order) verification of the order placed by the customer.
3.3. The possibility of canceling the order
Due to the fact that all orders placed by customers are processed at certain times by the IT system http://sklepuquina.pl, the customer may also be able to cancel the order. Detailed information on the possible possibility of canceling the order (including the time when the cancellation should take place) will be included in the order confirmation sent to the Customer, referred to in point. 3.2. above the Regulations.
3.4. The right to withdraw from the contract
3.4.1 The consumer acknowledges that pursuant to Art. 27 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended), he has the right to withdraw from a distance contract without giving reasons by submitting a statement to the Seller within 14 days from the date of release of the Goods.
The declaration of withdrawal from the contract can be submitted using the form, the content of which is in the dedicated section of the Help store website.
3.4.2 The right to withdraw from a distance contract is not entitled to the Consumer in the following cases:
• perishable goods (e.g. fresh vegetables, fruit, meat, cold meats, frozen foods if the cooling sequence is interrupted) or with a short shelf-life, including goods that due to their nature (e.g. frozen products) cannot be returned,
• goods delivered in sealed packaging, which cannot be returned after opening the packaging due to health protection or hygiene reasons, if the packaging has been opened after delivery,

3.4.3 In the event of withdrawal from the contract, the Consumer is obliged to return the goods to be returned unchanged, in particular, he should not use the goods in a way that goes beyond what is necessary to establish the nature, characteristics and functionality of the goods. Otherwise, the Consumer will be responsible for reducing the value of the Goods. The return of the goods should be made immediately to the address of the Seller, but not later than within 14 days from the date of receipt by the Seller of the notice of withdrawal from the contract. To meet this deadline, it is enough to return the Goods before its expiry.
3.4.4. The consumer bears only the direct costs of returning the goods, which should in particular be understood as the cost of returning the goods to the Seller to the following address: ul. Powstańców Wielkopolskich 18 lok. 2.15 / 02, 30-553 Kraków.
3.4.5. The Seller shall promptly, but not later than within 14 days of receiving from the Consumer a declaration of full or partial withdrawal from the contract, reimburse the Consumer for the payment made by him for the returned goods, and the costs of delivering the returned goods corresponding to the cheapest standard delivery method offered by the Seller.
3.4.6. The Seller may withhold the reimbursement of the payments referred to in the preceding point until the Consumer returns the goods to be withdrawn from the contract, or the Consumer provides confirmation that the goods have been returned, depending on which of these events ( return or delivery of confirmation) will take place earlier.
3.4.7. The reimbursement will be made using the method of payment used by the Consumer.
3.4.8. The right to withdraw from the contract does not exclude the Consumer's rights resulting from the Seller's liability for non-compliance of the goods with the contract.
3.4.9. The right to withdraw from the contract is not entitled to the customer if he has concluded the contract as part of his business (as an entrepreneur).
3.4.10 Within 14 days after the Seller receives the Customer's declaration of withdrawal from the contract, the Customer will receive a refund of the amount paid, including the cost of delivering the item corresponding to the cheapest standard delivery method offered by the Seller.
3.5. Delivery time
3.5.1 The delivery date depends on the Customer's preferences and the declared place of delivery.
3.5.2 Available delivery dates for a given order are specified each time in the order acceptance process.
3.5.3 Detailed information on delivery dates can be found in the dedicated section of the Store's Terms of Delivery.
3.6. Days off
3.6.1 The Seller does not execute orders on public holidays.
3.6.2 The Seller reserves the right to designate additional closing days for the store. It will not be possible to book a delivery date on these days.
3.7. Place and date of delivery of purchases
3.7.1 Depending on the Customer's preferences and the declared place of delivery, the order will be delivered to the address indicated by the Customer:
a.by the suppliers of the Store at Quina - within the agreed period between the Customer and the Store. This option is intended for wholesale customers in Krakow.
b. by a courier company - no later than on the third business day from the moment the order is placed for processing by http://sklepuquina.pl, however in the case of booked orders (in the case of orders paid in advance) or placed (in the case of orders paid on delivery):
 by 2 p.m. - Quina's store packs orders and hands them over to the courier on the next business day
 after 2 p.m. - The Quina Store packs the orders and hands them over to the courier company within 2 working days
3.7.2 In the event of a delay or failure to deliver the order within the time limit chosen by the Customer for reasons for which the Customer is not responsible, an employee of the Customer Service Department of the Quina Store will contact the Customer to arrange a different delivery date.
3.8. Refusal to execute the order
3.8.1 The Store at Quina reserves the right to refuse an order in the following cases:
3.8.1.1 There are clear doubts as to the person of the Customer (this applies in particular to cases of suspicion that the order data are placed by the same person using different accounts, e.g. to circumvent specific quantitative restrictions on the Goods offered as part of promotional campaigns) .
3.8.1.2 The order could not be confirmed, and it was considered by http://sklepuquina.pl as requiring confirmation in accordance with point 3.2 above.
3.8.1.3 The customer does not comply with the rules of the Regulations.
3.8.1.4 The order cannot be processed for logistical reasons (e.g. when, due to the nature of the Goods, they are not available on a given day - e.g. fresh bread on Sunday or on a holiday).
3.8.2.1 The Seller reserves the right to limit sales to the Customer. This condition applies to products in the promotion marked with the sign "Cheapest in the network", "Super price", "Product from the newsletter" or other indication of the promotional price of the offered product. The Customer is informed about any possible limits each time the order is placed.
3.8.2.2 The Seller reserves the right to limit sales to the Customer due to the current inventory of the products on offer. The Customer is informed about any possible limits each time the order is placed.
3.9. Invoice
3.9.1 The Seller informs that, in accordance with the provisions of the Value Added Tax Act in force from January 1, 2020, the Seller may issue an invoice for the VAT or value added tax payer only if the Customer provides his NIP number when placing the order. (EU VAT), otherwise the Seller will not be able to issue an invoice with the Customer's tax identification number (EU VAT) at a later time.
3.9.2 VAT invoice covering all delivered order items, as well as collective invoices that are issued for some business customers at the end of the billing period and include all deliveries delivered during this period, as well as corrective invoices are issued in electronic form and posted on the website The Seller - on a dedicated Customer account - in a manner ensuring the authenticity of the origin of the documents, integrity of the content and legibility until the end of the limitation period and at the same time enabling the Customer to download them, and information about the provision of a VAT invoice or corrective invoice is sent via e-mail to the e-mail address The customer indicated in the registration process along with information about completing the order.
3.9.3 By placing the order itself, the Customer each time accepts that the VAT invoice and the correcting invoice for a given order are issued in electronic form and placed on the Customer's account in a way that allows it to be downloaded, and the information about making the invoice available is sent via e-mail to the following address. Customer's e-mail indicated in the registration process along with information about completing the order.
3.9.4 The VAT invoice or correcting invoice will be made available in PDF format. This means that in order to be able to read the file containing the VAT invoice or correcting invoice, the Customer must have the appropriate software installed.
3.9.5 The customer authorizes the Quina Store to issue VAT invoices without the recipient's signature.
3.9.6 In the case of a Customer as a consumer, when the applicable regulations require the recording of sales with a cash register, the Store at Quina will fulfill all obligations resulting from the tax regulations in force in this regard.

4. Payment
4.1. Payment methods
The customer makes payments for purchases made at http://sklepuquina.pl in the manner specified in the order acceptance process. The following payment methods are possible:
4.1.1 for purchases made by suppliers Store at Quina:
• online payment by bank transfer
• payment by bank transfer with deferred payment (for business customers constantly cooperating with the Store at Quina).
4.1.2 for purchases made through a courier company;
• online card payment
• online transfer payment (all internet banks)
The Quina Store informs that in special cases, due to the assortment covered by a given order, some payment methods may not be available, due to the limitations resulting from the agreements linking the Store at Quina with a given payment service provider.
Depending on the situation of the coronavirus pandemic, we reserve the right to temporarily suspend "contact" payment methods.
4.2. Settlement of underpayments and overpayments
4.2.1 The client may at any time check the balance of his balance in the 'Settlements' tab after logging in to his account in ... ............, but this status may be different from the value indicated in the item "Balance settlement" on the VAT invoice due to the volatility of the balance over time as a result of ongoing transactions in the store's panel (e.g. accepted complaints, granted vouchers, etc.)


5. Delivery
5.1. Supplier
5.1.1 Deliveries may be made by the suppliers of the Store at Quina or by the courier company:
5.1.1.1 The Supplier may issue an order to the Customer or another person present at the address provided by the Customer.
5.2. Customer absence
When placing an order, the Customer - in accordance with the provisions of these Regulations - selects the place of delivery and selects the date of delivery. Consequently, the customer should be present at the place and time of delivery indicated by him
5.2.1 Delivery carried out by the supplier of the Store at Quina.
5.2.1.1 In the absence of the Customer at the delivery address indicated by him in the indicated hourly period, an employee of the Customer Service Department of the Store at Quina attempts to contact the Customer.
5.2.1.2 If it is possible to set a new delivery date, the supplier of the Store at Quina will try to deliver the goods to the Customer at a later date. In this case, the Customer will incur an additional fee of PLN 15.
5.2.2 Delivery by a courier company:
5.2.2.1 In the absence of the Customer at the delivery address indicated by him, an employee of the courier company will leave a notification.
5.2.2.2 The courier will make additional attempts to deliver the package, after which it will be returned to the Store at Quina.
5.2.2.3 The Store at Quina is not responsible for any difficulties in the delivery of the parcel on the part of the Customer.
5.2.2.4 Quina Store will try to resend the package after the obstacles to delivery of the order have been eliminated. In this case, the customer must take into account an additional fee for the re-shipment for reasons attributable to the customer.
5.2.2.5 Except in cases of non-performance or improper performance of the contract by the Seller, the courier company is responsible for the actions of the courier company employee when delivering the order to the Customer.

6. Complaints and returns
6.1. The seller's obligation is to deliver the ordered goods free from defects to the Customer.
6.2. In the event of non-compliance of the delivery with the order placed, the Customer should notify the supplier and refuse to accept products that he did not order.
6.3. In the event of damage to the goods during transport or delivery of an article with a manufacturing defect, the Customer is obliged to contact the Customer Service Office of the Store at Quina, after which he may return the goods received and request a refund.
6.4. In the event of non-compliance of the goods with the contract, the buyer has the right to request replacement of the goods or reduction of its price or withdrawal from the contract. In order to make a complaint, please contact the Customer Service Office of the Store at Quina
6.5. The reported complaint will be considered within 14 days of its transfer to the Customer Service Office of the Store at Quina, by e-mail to the address [email protected]. Written information about the result will be sent to the e-mail address or home address. Failure to reply within the indicated period will be considered a positive consideration of the complaint.
6.6. The shop at Quina reimburses the customer for the returned or complained goods within 7 days from the date of positive consideration of the complaint, to the account specified by the customer or by postal order to the address indicated in the order.
6.7 The Store at Quina does not accept any cash on delivery returns.
6.8. The store at Quina is not responsible for the quality of the products if the quality has deteriorated after the products have been delivered to the customer and for reasons attributable to the customer (perishable products, fresh products, with short expiry dates, etc. - e.g. in a situation where the customer has not stored products frozen in the freezer compartment).
6.9. The store at Quina as a seller informs the customer about the possibility of using out-of-court methods of dealing with complaints about the Goods, including by submitting by the Client, after the end of the complaint procedure, an application to initiate mediation or an application for consideration of the case before an arbitration court. The list of permanent Consumer Arbitration Courts operating at the Provincial Inspectorates of the Trade Inspection is available here. Out-of-court redress after the complaint procedure is completed is free of charge. In the case of a Customer who is a consumer, who wants to use an out-of-court method of redress, it is also possible to file a complaint via the EU ODR online platform, available at this address.


7. Final provisions
7.1. Obligation to provide truthful information
The customer using the services of the Store at Quina is prohibited from providing false data. The Store at Quina is not responsible for the failure to provide the service in this case.
7.2. E-mail delivery
The Store at Quina is not responsible for failure to deliver a message sent to the email address provided by the Customer, which may be caused by blocking or deleting e-mails by software installed on the computer used by the Customer or blocking by mail server administrators or other failure.
7.3. Refunds
In the event of refusal to execute the order in accordance with the provisions of the Regulations or in the event of unavailability of products ordered and paid by the Customer, or in the event of the Customer canceling the order previously paid for, the Store at Quina will make a full return of the amount paid in accordance with the provisions of point 3.5.7. of these regulations. In the absence of a request from the Customer, the Customer authorizes the Store at Quina to deduct the resulting overpayment (related to a canceled or incomplete order) from the value of the next order.
7.4. Changing the regulations
7.4.1 The Store at Quina reserves the right to amend the Regulations with effect for the future for the following important reasons:
a) a new functionality of the website or application will be introduced, the use of which cannot be based on the existing Regulations,
b) the change is required by law,
c) the existing functionality of the website or application will be changed, in particular in order to increase the comfort or facilitate the use of the website or application,
d) new services or rules for making purchases will be introduced or changes to the services provided or the rules for making purchases, the use of which cannot be based on the existing Regulations.
7.4.2. The registered Customer will be informed about each amendment to the Regulations by e-mail or in writing,
7.4.3. The amendment to the Regulations comes into force after 14 days from the date of sending information about the amendment to the Regulations to registered customers,
7.4.4. The provisions of the Regulations in force at the time of placing the order shall apply to orders placed and not processed before the effective date of the new Regulations.
7.4.5. In the event of any change to the Regulations, registered customers have the right resign from the services provided within 14 days from the date of notifying them of the change in the Regulations. .
7.5. Disputes
Disputes are examined by the competent common court determined in accordance with the provisions of the Act of 17 November 1964, Code of Civil Procedure (Journal of Laws of 1964, No. 43, item 296, as amended).
7.6. Customer satisfaction survey
After delivering the Goods to the Customer, the Store at Quina reserves the right to examine the Customer's opinion on the transaction by sending the Customer to the e-mail address provided in the order an invitation to complete the survey (the Customer is not obliged to complete it) and by telephone contact.

8. Consolidation, security and access to the text of the contract
8.1. Consolidation, protection and sharing of order data takes place via e-mail.
8.2. Consolidation, security and disclosure of general terms and conditions (sales regulations) takes place via the website http://sklepuquina.pl in a dedicated section of the website. Regulations.
8.3. Earlier orders can be seen by the customer after logging in to the store http://sklepuquina.pl and going to the "My orders" tab.
9. Personal data
The administrator of the Customer's personal data provided when registering an account or placing an order (including: name, surname, e-mail address, telephone number, delivery address) is QUY PHAM THI KIM QUIN ASIA.
Personal data provided when setting up an account will be processed for the purposes of:
• execution and handling of orders pursuant to Art. 6 sec. 1 lit. b GDPR, which indicates that processing is necessary for the performance of a contract to which the data subject is a party,
• take action at the request of the data subject before concluding the contract,
• statistical on the basis of art. 6 sec. 1 lit. f GDPR, i.e. the legitimate interests pursued by the Administrator.
In the event of consent to marketing, the data is also processed for marketing purposes (the basis for processing is Article 6 (1) (a) of the GDPR, i.e. the Customer's consent).
The recipient of personal data will be entities cooperating with the Administrator, which support him in his daily activities by providing administrative, marketing and IT services as well as suppliers of orders placed in the online store.
The administrator does not intend to transfer data to third countries or international organizations.
Personal data provided for the purpose of processing and handling the order will be stored for the period of:
• in the case of creating an account in the online store - in the IT system supporting the store for 3 years from the date of last activity and the expiry of the limitation periods for claims resulting from completed orders
• in the event of deletion of the account, all data will be deleted, except for the data necessary for the complaint process and handling any claims, which will be stored until the expiry of the limitation periods for claims resulting from completed orders,
and the data is processed for marketing purposes - until the consent is withdrawn or until an objection to their use is raised.
The customer has the right to:
• request access to your personal data, rectification, deletion, limitation of their processing, as well as the right to transfer data,
• withdraw consent to data processing at any time; this does not affect compliance
with the right to process based on consent before its withdrawal,
• lodging a complaint to the President of the Personal Data Protection Office with its seat in Warsaw (00-193), Stawki 2.
The data may be processed in an automated manner, including profiling, consisting in creating personalized product offers available in the store's assortment ... ................, presenting them on the website and sending them in marketing messages via http://sklepuquina.pl, which can have a significant impact on the customer by enabling him to purchase products at the prices indicated in the offer.
Providing data is voluntary and at the same time is a condition for concluding a contract necessary for its implementation. After the end of the processing of personal data for the original purpose, the data will not be processed further.
